1. Acceptance of Terms

By engaging our services or using our website at MyWebsiteDesigner.US, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, please do not use our services or website.

These Terms of Service constitute a legally binding agreement between you (the "Client") and MyWebsiteDesigner.US ("we," "our," or "us"). We reserve the right to modify these terms at any time with notice posted on our website.

2. Services

MyWebsiteDesigner.US provides web design, web development, digital marketing, AI solutions, and related creative and technical services as described on our website. The specific deliverables, timelines, and pricing for each engagement are outlined in individual project proposals and service agreements provided to each client prior to project commencement.

We reserve the right to decline any project at our discretion. Acceptance of payment does not constitute a binding agreement until a written project proposal has been signed or explicitly confirmed by both parties.

3. Payment Terms

The following payment terms apply to all projects unless otherwise specified in a written project agreement:

A 50% deposit is required before any project work begins. Work will not commence until the deposit has been received and cleared.
The remaining balance is due upon project completion and before the website or deliverable goes live or is transferred to the client.
All payments are made in U.S. dollars. We accept major credit cards, ACH bank transfer, and check.
All payments are non-refundable after work has commenced, except as provided in our 30-Day Satisfaction Guarantee (Section 7).
Invoices not paid within 14 days of the due date may result in a pause of project work until payment is received.

For clients who choose installment payment plans, the agreed schedule is binding. Failure to make installment payments may result in a hold on project deliverables.

4. Intellectual Property

Upon receipt of full and final payment, the Client owns all custom design assets, code, and content created specifically for their project, including but not limited to:

Custom graphics, logos, and visual design elements created for the project
Website code and templates built from scratch for the project
Written content authored specifically for the client's website

MyWebsiteDesigner.US retains the right to display completed work in our portfolio, case studies, social media, and marketing materials, unless the client requests otherwise in writing.

Third-party assets incorporated into the project — including stock photographs, licensed fonts, stock icons, plugins, themes, and software — are subject to their respective third-party licenses. Responsibility for ongoing compliance with third-party license terms transfers to the client upon project handoff.

5. Client Responsibilities

Clients are responsible for the following throughout the project:

Providing accurate, complete, and up-to-date business information, including branding, content, photos, and any other materials required for the project.
Providing timely feedback and approvals within the agreed project timeline. Delays caused by the client that extend the project beyond its scheduled completion date may result in revised pricing.
Providing necessary credentials, logins, and access to relevant platforms (hosting, domain, existing CMS, etc.) in a timely manner.
Ensuring that all content provided for publication — including text, images, videos, and trademarks — does not infringe on the intellectual property rights of any third party and complies with all applicable laws.
Complying with all applicable federal, state, and local laws and regulations related to their business and the use of the delivered website.

6. Limitation of Liability

To the fullest extent permitted by applicable law, MyWebsiteDesigner.US shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or loss of business opportunities, arising from or related to your use of our services or the performance of any delivered website.

Our total cumulative liability to you for any and all claims arising from or related to a specific project shall not exceed the total amount paid by you to MyWebsiteDesigner.US for that specific project.

We do not guarantee specific business outcomes, search engine rankings, or revenue results from any website or marketing campaign we deliver. Results described in case studies and marketing materials represent past performance and are not guarantees of future outcomes.

7. Satisfaction Guarantee

We offer a 30-day satisfaction guarantee on all completed website projects. If you are not satisfied with the final deliverable after it has been delivered, we will work with you to revise it within the scope of the original project agreement.

This guarantee covers design and functionality issues directly related to the agreed project scope. It does not cover changes to the original scope, new feature requests, or dissatisfaction resulting from changes in your business direction or preferences after project delivery.

Refunds are at our sole discretion after project completion and delivery. In the event a refund is deemed appropriate, it will be processed within 14 business days.

8. Termination

Either party may terminate an active project engagement with 14 days written notice delivered via email. In the event of termination:

Payment is due for all work completed to the date of termination, calculated on a pro-rata basis against the total project price.
MyWebsiteDesigner.US will deliver all completed work product to the client upon receipt of payment for completed work.
The deposit is non-refundable in the event of client-initiated termination after work has commenced.
MyWebsiteDesigner.US reserves the right to terminate immediately without notice in cases of non-payment, abusive conduct toward our team, or illegal activity.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from or related to these terms or our services that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

Both parties agree to attempt informal resolution of any dispute before initiating formal legal proceedings. Written notice of a dispute must be provided to the other party at least 30 days before filing any legal claim.
